Terms of Service

These terms govern your use of Hermes. They are written to be readable; the headings below cover the essentials.

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of Hermes, provided by Arthea LLC ("Arthea", "we", "us"). By using Hermes you agree to these Terms. If you are using Hermes on behalf of an organization, you agree on its behalf.

2. The service

Hermes is an operating system for influence: a platform to run paid partnerships, product gifting and affiliate programs, with creator CRM, campaign execution, attribution and automation. We may update, improve or change features over time.

3. Accounts

You are responsible for your account, for keeping credentials secure, and for activity that occurs under it. You must provide accurate information and promptly update it.

4. Acceptable use

You agree to use Hermes lawfully and not to misuse it.

  • No unlawful, infringing, deceptive or harmful activity.
  • No attempts to disrupt, reverse engineer or gain unauthorized access to the service.
  • No sending of unlawful or unsolicited communications through the platform.
  • You are responsible for your campaigns and disclosures, including applicable advertising and FTC rules.

5. Customer data and ownership

You retain all rights to the data you put into Hermes. You grant Arthea a limited license to process that data solely to provide and improve the service. We process personal data as described in our Privacy Policy and any applicable Data Processing Addendum.

6. Subscriptions and billing

Paid plans are billed in advance on the cadence shown at checkout. Fees are non-refundable except where required by law. We may change pricing with notice effective on your next renewal.

7. Third-party services

Hermes integrates with third-party platforms such as Shopify and ad networks. Your use of those services is governed by their own terms, and we are not responsible for them.

8. Intellectual property

Hermes, including its software, design and brand, is owned by Arthea LLC and protected by law. These Terms do not grant you rights to our intellectual property except the limited right to use the service.

9. Disclaimers

The service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free or that results, including attribution estimates, will be exact.

10. Limitation of liability

To the maximum extent permitted by law, Arthea will not be liable for indirect, incidental or consequential damages, and our total liability is limited to the amounts you paid for the service in the twelve months before the claim.

11. Indemnification

You agree to indemnify Arthea against claims arising from your data, your campaigns, or your breach of these Terms.

12. Termination

You may stop using Hermes at any time. We may suspend or terminate access for breach of these Terms or to protect the service. On termination, you may export your data for a reasonable period.

13. Governing law and changes

These Terms are governed by the laws applicable to Arthea LLC, without regard to conflict-of-laws rules. We may update these Terms; material changes will be posted here with an updated date, and continued use constitutes acceptance.
